The Defendable 401(k)® Plan PERFORMANCE Plan Investment Choices – We utilize Modern Portfolio Theory to create risk and return profiles for a broad range of employees and then allow employees, using a risk tolerance questionnaire, to match themselves to model portfolios while still maintaining the flexibility to allow individual employees to design their own portfolio. We optimize fund choices within those portfolios using CSSC's patented, decision-assistance technology, drawing from among the broadest available universe of fund choices with the goal of achieving optimal cost-adjusted performance, and, providing an ongoing monitoring capability with a degree of transparency and fiduciary control that we have found available nowhere else. ADMINISTRATIVE EASE We use sophisticated administrative platforms capable of utilizing multiple national–level custodians to help ensure operational ease and a sustainable high degree of participant and plan sponsor satisfaction. DEFENDABILITY Finally, for the Plan’s trustees themselves – in an increasingly litigious world, the "defendability" of decisions is an area of increasingly serious concern. Demonstrating fiduciary "prudence" has been linked to having a defendable decision-making "process." The Defendable 401(k) platform provides an enhanced degree of defendability – the defendability that trustees for so long have been without and have been looking for.
